A developer wants to control the size and nature of structures and other obstacles that can be built or placed on the land by the landowner and third parties during the term of the wind energy contract. An effective way to achieve this control is to place a sufficient burden on the property to build, operate and protect the project and its wind resource, and to include in the wind energy agreement land agreements that limit the owner`s right to disrupt the flow of wind on the land. The same applies where the objective is to maintain a wind easement for the full flow of wind and/or to reserve to the transferring owner the right to control or take into account the future development of the land for wind purposes and there is currently no wind land agreement that weighs on the land. .
